Permit exemption follows IRC R105.2 as adopted by Bellingham (BMC 17.10.020). Exempt structures must still comply with all land use setback and placement regulations.

Fences and walls within land use setbacks have separate height restrictions that apply even without a building permit.

Accessory buildings shall not exceed one story in height, or 12 feet under either height definition. Accessory buildings may be located in a rear yard and in the rear 22 feet of an interior side yard.

What You Need to Know

  • Placement (BMC 20.30.100): Accessory buildings may be located in the rear yard and in the rear 22 feet of an interior side yard. They cannot be placed in front yards or forward of the primary structure.
  • 12 ft height cap (BMC 20.30.100): Accessory buildings shall not exceed one story or 12 feet under either height definition. This is a hard cap — no exceptions without a conditional use permit.
  • 800 sq ft max (BMC 20.30.100): Accessory buildings cannot exceed 800 square feet in area. Larger accessory buildings require conditional use permit approval.
  • Setbacks (BMC 20.30.040): Setback distances are defined by your zone in Table 20.30.040. Accessory buildings follow the same setback rules as main buildings, except they can be placed within the rear 22 ft of interior side yards.
  • Outside city limits? If your property is in unincorporated Whatcom County rather than within Bellingham city limits, Whatcom County rules apply instead.
  • Utilities: Even if the structure is exempt from a building permit, any electrical or plumbing work requires a separate trade permit.
